TERMS OF SALE

These Terms of Sale govern your purchase of products ("Products") from BADBOY TENNIS LLC ("Bad Boy Tennis," "we," "us," or "our") through www.badboytennis.com (the "Site"). By placing an order, you agree to be bound by these Terms of Sale, which are incorporated into and governed by our Terms and Conditions, including the arbitration provision, class action waiver, warranty disclaimer, and limitation of liability set out there.
1. OUR PRODUCTION MODEL
The majority of our Products are made to order after you place your order. This approach reduces overproduction and waste, and it means each piece is produced individually for you.
● Fulfillment time. Because each item is made to order, there is a production period before shipment. This is typically two to five business days but may vary. It is separate from and additional to transit time.
● Order acceptance. Your order is an offer to purchase. We accept your offer by processing payment and shipping the Product. We may refuse or cancel any order for any lawful reason, including availability, an error in the description or price of a Product, suspected fraud, or suspected unauthorized resale. If we cancel an order after charging you, we will issue a full refund to the original payment method.
● Cancellations and modifications. Because production begins quickly, we cannot guarantee that an order can be cancelled or modified once submitted. Contact hello@badboytennis.com as soon as possible and we will do what we can. This does not affect your rights under our Return and Refund Policy.
● Order limits. We may limit quantities available for purchase per person, per household, or per order.
2. PRICING AND PAYMENT
● Currency. All prices are listed in U.S. Dollars.
● Price changes. Prices are subject to change without notice. The price applicable to your order is the price displayed at the time we accept it.
● Pricing errors. Despite our efforts, a Product may occasionally be listed at an incorrect price or with incorrect information. If a Product's correct price is higher than the price shown, we will either contact you for instructions before shipping or cancel the order and notify you. We are not obligated to honor an order placed at an obviously incorrect price.
● Taxes. Displayed prices exclude taxes. Applicable sales tax is calculated and added at checkout based on your shipping address.
● Payment authorization. By providing a payment method, you represent that you are authorized to use it and you authorize us or our payment processor to charge the full order total, including tax and shipping.
● Promotional codes. Discount codes are subject to any stated terms, may not be combined unless stated, have no cash value, and may be withdrawn at any time. We may cancel orders placed with codes obtained through unauthorized channels.
● Chargebacks. If you believe a charge is in error, please contact us before disputing it with your card issuer. We will work with you in good faith. We reserve the right to refuse future orders from accounts with a history of unsubstantiated chargebacks.
3. INTERNATIONAL ORDERS, CUSTOMS, AND DUTIES
Orders delivered outside the United States may be subject to import duties, taxes including VAT, and other fees imposed by the destination country.
● Your responsibility. Unless stated otherwise at checkout, you are solely responsible for all customs duties, taxes, and fees.
● Disclaimer. We have no control over these charges and cannot predict them. Customs policies vary by country. Please contact your local customs office for information. We are not responsible for delays caused by customs clearance.
● Refused or abandoned parcels. If a parcel is refused or abandoned because duties were not paid, any refund will be net of shipping and any charges incurred.
4. SHIPPING AND DELIVERY
Our shipping practices are described in our Shipping Policy.
● Delivery estimates. Production and delivery windows displayed on the Site are good faith estimates based on information reasonably available to us and are not guaranteed delivery dates unless expressly stated otherwise.
● Delays and your right to cancel. If we cannot ship within the time stated at the point of sale, or within thirty (30) days where no time was stated, we will notify you of the revised shipment date and offer you the choice to consent to the delay or to cancel the affected unshipped items for a prompt full refund. Where a delay is indefinite or a second delay occurs, we will cancel and refund unless you affirmatively consent to continue. Nothing in this provision limits any right available to you under applicable law.
● Risk of loss. Title and risk of loss pass to you upon our delivery of the Products to the carrier. Where a shipment is lost or damaged in transit, we will provide reasonable assistance with a carrier claim and, at our discretion, may replace the order. Contact us within thirty (30) days of the expected delivery date.
5. RETURNS, EXCHANGES, AND REFUNDS
Our returns process, timeframes, and conditions are set out in full in our Return and Refund Policy, which forms part of these Terms of Sale. In summary, we accept returns and exchanges of unworn, unwashed Products in original condition with tags attached within thirty (30) days of delivery, and we replace or refund any Product that arrives misprinted, damaged, or defective. Size exchanges and store credit are free of charge. A $7.00 handling fee applies to refunds returned to the original payment method. 6. PRODUCT REPRESENTATION, DIGITAL AND AI IMAGERY, AND VARIATION
We strive to present our Products accurately. You acknowledge and agree that images on the Site are for illustrative purposes and may not be an exact representation of the final Product.
● Digital and AI generated imagery. Many images on the Site are digital representations, which may include computer generated mockups and imagery created with artificial intelligence. This applies to depictions of the Products, to the models on which they are shown, and to atmospheric, editorial, and background imagery. Such imagery is illustrative and is not a representation of any specific individual, facility, or production process. Where a fit reference such as a model's height and size is given, it is a styling reference only and is not a representation about an identified individual.
● Colour variation. Colours displayed on your screen may differ from the actual Product because of monitor settings, screen resolution, and lighting.
● Print placement and scale. The exact placement, size, and scale of printed or embroidered graphics may vary slightly from the mockup shown. Minor variation is a normal characteristic of on demand production and is not a defect.
● What this does not limit. This Section describes normal variation. It does not limit your rights under our Return and Refund Policy, and it does not apply to a Product that is misprinted, materially different from what was ordered, damaged, or defective.
7. PRODUCT ORIGIN AND MATERIAL INFORMATION
● Design and origin. Bad Boy Tennis is designed in New York. Our garments are decorated, embroidered, and finished by our production partners using globally sourced blank garments. The country of origin of the base garment is stated on each product page where available.
● Material and performance claims. Fabric composition, weight, and performance information, including any sun protection rating or recycled content figure, is provided to us by our garment suppliers and is stated to the best of our knowledge. Care instructions should be followed to preserve fit, colour, and decoration.
8. NO RESALE
Products are sold for personal use. You may not purchase Products for the purpose of unauthorized commercial resale. We may refuse or cancel orders we reasonably believe are placed for resale.
9. DISPUTES, GOVERNING LAW, AND LIABILITY
These Terms of Sale incorporate Sections 11 through 16 of our Terms and Conditions, covering informal resolution, binding individual arbitration, the class action waiver and your right to opt out of it, governing law and venue, disclaimer of warranties, and limitation of liability.
